Birmingham, Mich.—June 28, 2024 –Birmingham-based full-service business law firm Williams Williams Rattner & Plunkett (WWRP) is pleased to announce a real estate win in a case the City of Dearborn (Michigan) filed against a WWRP client. The order was entered on June 26, 2024, by the Honorable Muriel Hughes, Judge of the Wayne County Circuit Court.
The case, led by WWRP real estate attorneys Jason Long and Jerome Pesick – both partners in the firm – involved the City of Dearborn seeking to use a deed provision to attempt to claw back properties the city had conveyed to the client more than 30 years ago. The city moved for summary disposition, but Long and Pesick turned that around, arguing instead that the Court should grant summary disposition in favor of the client – and the Court agreed with them.
“The case involved the city’s arguments that, as a governmental agency, certain limitations periods did not apply to its effort to reclaim the properties in question. Nevertheless, the Court agreed with us that the statutes exempting the city from certain limitations periods did not apply to this case. So the city was too late in attempting to reclaim the properties,” Long said. Pesick added, “We are extremely pleased with the outcome, preserving hundreds of thousands of dollars of our client’s assets.”
